These Terms of Service explain the rules for using the OB Operations website and services, including our SMS text messaging.

By accessing or using the website located at oboperations.net (the "Site"), submitting a form on the Site, or using any service provided by OB Operations ("OB Operations," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). OB Operations provides website design and hosting, lead capture tools including contact forms, job scheduling forms, and an AI chatbot, lead tracking and organization, review request automation, and automatic call and text back services for missed calls. These services are provided directly to businesses that engage OB Operations (our "clients"). In connection with these services, SMS text messages may be sent by OB Operations on our own behalf and on behalf of our clients to individuals who contact a client's business, for example, a caller who misses a call may receive an automatic text message with a link back to that client's website.
By using the Site, submitting a form, interacting with a chatbot, or receiving a text message connected to OB Operations or one of our clients, you agree to these Terms.
When using the Site or submitting information through a form, chatbot, or other tool provided by OB Operations, you agree to:
By submitting your phone number through a web form on the Site, or by contacting a business that uses the OB Operations System, you may opt in to receive SMS text messages from OB Operations or from the client business on whose behalf OB Operations is messaging. Consent to receive SMS messages is collected through an opt-in web form.
Carriers are not liable for delayed or undelivered messages. Not all mobile devices or carriers may be supported.
The Site and its original content, including text, graphics, logos, and design elements, are the property of OB Operations and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Site without our prior written permission.
To the fullest extent permitted by law, OB Operations and its owners, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business, or goodwill, arising out of or in connection with your use of the Site, our services, or any SMS communications, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from your use of the Site or our services shall not exceed the amount you paid to OB Operations, if any, in the twelve months preceding the claim.
The Site and our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law principles.
